Arizona Governor Doug Ducey Signs Construction Defect House Bill 2578

Arizona Governor Doug Ducey signed into law House Bill 2578 which makes it more challenging for homeowners to sue home builders for construction defects. The new law states that both sides in a lawsuit are responsible for paying their own legal costs (attorney's and expert witness fees). The challenge for homeowners is that attorney's and expert witness fees are generally so high that even if a homeowner wins a lawsuit, there isn't much left-over to cover the costs of repairs.

Spencer Kamps, vice president of legislative affairs for the Home Builders Association of Central Arizona, said the goal of the new law is to reduce the number of frivolous lawsuits being filed.

Regarding this new law, William Shore, an attorney and partner at Phoenix-based Burdman Law Group said "...this is going to be an enormous problem for homeowners going forward".
