A Bernalillo County grand jury indicted Solomon Peña on 14 charges for allegedly planning shootings targeting the hones of local Democratic officials.
The charges include:
Criminal Solicitation to Commit Shooting at a Dwelling or Occupied Building (3 Counts); Shooting at a Dwelling or Occupied Building (No Great Bodily Harm) (Firearm Enhancement); or in the Alternative: Shooting at or from a Motor Vehicle (No Great Bodily Harm)(Firearm Enhancement) (3 Counts); Conspiracy to Commit Shooting at a Dwelling or Occupied Building (2 Counts); Unlawful Taking of a Motor Vehicle (2 Counts); Shooting at a Dwelling or Occupied Building (No Great Bodily Harm) (Firearm Enhancement) ; Attempt to Commit a Felony, to Wit: Aggravated Battery (Deadly Weapon) (Firearm Enhancement) ; Receipt, Transportation or Possession of a Firearm or Destructive Device by Certain Persons (2 Counts).

In 2007 Peña and several others were charged with multiple felonies in a "smash and grab" burglary at an Albuquerque K-Mart.
For that offense Peña served nearly seven years in prison, from May 2009 to March 2016. Upon his release he was placed on supervised probation until March 2021.

Solomon Peña was arrested by Albuquerque Police in connection with multiple shootings targeting homes of Democratic elected officials.
Last month on December 4, December 8, December 11, and this month on January 3, shots were fired at the homes of County Commissioner Adriann Barboa, Representative Javier Martínez, County Commissioner Debbie O'Malley, and Representative Linda Lopez, respectively. in three of those shootings, bullets stuck or entered the homes. In the other home, damage to the home indicated probable gunfire.
Albuquerque Police Chief Harold Medina said Peña is accused of paying four men to shoot at the four homes. Medina also suggested the shootings were "politically motivated."
At a news conference Albuquerque Mayor Tim Keller said:
They were dangerous attacks not only to these individuals...but, fundamentally, also to democracy.
Peña was a Republican candidate in the 2022 midterm elections who ran against incumbent Democrat Miguel Garcia representing New Mexico's 14th legislative district. Peña, who received 26.4 percent of the vote, was defeated by Garcia who received 73.6 percent of the vote (a difference of 3,583 votes).
On Twitter Peña claimed the 2022 election was "rigged."

In a January 2, 2023 tweet, responding to another tweet, Peña tweeted:
Si, mine was also rigged. And I will fight it until the day I die.
